In the Mix Sweepstakes – Official Rules

These rules (the “Rules”) pertain to and shall govern the terms of participation in The Wild Honey Pie’s “In The Mix” sweepstakes (the “Sweepstakes”). By reading these Rules and participating in the Sweepstakes each participant in the Sweepstakes (each a “Participant”) irrevocably and unconditionally accepts the same and agrees to be bound by all of the conditions contained herein.

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. NO PURCHASE WILL IMPROVE YOUR CHANCES OF WINNING.

DEFINITIONS:

  • Sponsor: The Wild Honey Pie, LLC (hereafter “TWHP”)
  • Sweepstakes Entities: individually and collectively, TWHP, Desert Door
HOW TO ENTER:
  • Eligible Participants may enter the Sweepstakes by following the terms of these Rules and following the instructions located at the following URL: thewildhoneypie.com/inthemix (the “URL”). The winner will be chosen from eligible and approved entries.
  • Entry Period: Entries must be submitted on or after 12:01am (EST) November 13, 2020, and no later than midnight (EST) on March 31, 2021. 
  • Only one entry per Participant may be submitted.
  • Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different addresses, accounts, identities, registrations and logins, or any other methods, including an automated system, will void that entrant’s entries and that entrant may be disqualified. Each potential winner may be required to show proof of being the authorized account holder. TWHP shall have the right to determine the identity of a potential winner in its sole discretion.
  • This Sweepstakes is open to all legal residents of the 50 United States, including Washington, D.C., that are 21 years of age or older as of time of entry. Employees of Sweepstakes Entities and members of such employee’s immediate families are not eligible.
HOW WINNERS ARE SELECTED AND NOTIFIED
  • Nine (9) Sweepstakes winners will be selected at random from all eligible entrants.
  • In addition to the nine (9) Sweepstakes winners, approximately 45 entrants will be selected at random to receive a free t-shirt.
  • The odds of winning depend on the number of eligible entries received.
  • The winners will be notified via email following the conclusion of the Entry Period. TWHP is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or winner’s failure to adequately monitor the email account. Return of any prize notification as undeliverable or any other non-response within three (3) business days of notice, will result in disqualification and selection of an alternate potential winner at random from all remaining eligible Participants.
THE PRIZE(S):
  • Each of the nine (9) winners shall receive one (1) autographed vinyl record from one of the participating artists identified on the URL.
  • Approximate Retail Value of each of the Prizes: $45 for autographed vinyl, $15 for T-shirts.
  • No more than the stated number of prizes will be awarded. In the event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Rules to be available and/or claimed, TWHP reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible reward claims.
ADDITIONAL SWEEPSTAKES TERMS:
  • Decisions of the Sweepstakes Entities are final on all matters relating to this giveaway. By entering, entrants agree to the use of their name, biographical information and photograph/likeness for advertising and promotional purposes, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation, except where prohibited by law.Upon request, winners will consent to such in writing and may be asked to sign a release form.
  • Any information collected from Sweepstakes entrants will be used to enter the entrant into the Sweepstakes, and may be provided to Sweepstakes Entities who may notify the Sweepstakes winners, and may be used in any other manner as may be set forth in these Rules or in the TWHP terms and conditions and privacy policy.
  • By participating, each Participant grants TWHP permission to use his/her name, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law.
  • No transfers, substitutions in prizes or cash will be allowed except by TWHP, who may substitute a prize of equal or greater value. All prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) by Sweepstakes Entities.
  • By entering and/or by accepting a prize, you agree to be bound by these Rules and to release and hold harmless Sweepstakes Entities, all their affiliates, subsidiaries, advertising and promotions agencies, and each of their respective agents, representatives, officers, directors, shareholders, employees and assigns from any and all liability arising out of your participation in this Sweepstakes including, without limitation, with respect to the awarding, receipt, use and/or misuse of any prize or cancellation of the Sweepstakes. Winner participates in the use of the prize with knowledge of the danger involved and agrees to accept any and all risks of death, serious illness and injury, and property damage.
  • TWHP reserves the right to disqualify and prosecute to the fullest extent permitted by law any entrant or winner who, in TWHP’s reasonable suspicion, tampers with TWHP site, the entry process, intentionally submits more than a single entry, violates these rules, or acts in an unsportsmanlike or disruptive manner.
  • Liability for any applicable taxes and any other expenses not specifically provided for by TWHP in these Rules are the sole responsibility of the winner.
  • Entries that are lost, late, illegible or incomplete for any reason will not be eligible. TuneCore reserves the right to modify or terminate this Sweepstakes or disqualify any entry for any reason. In the event of early termination, TWHP will randomly select winners from all eligible entries received at time of termination.In the event of a dispute concerning the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the email account is registered or the authorized account holder associated with the email account.
  • This Sweepstakes is subject to federal, state and local laws with venue in New York County in the State of New York, and except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in the State of New York. The remedy for any claim will be limited to actual damages, and in no event will any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
  • By entering, you agree, to be bound by the TWHP terms of use and privacy policy, and you give your express permission to be contacted by Sweepstakes Entities by e-mail in the future, including promotional emails in connection with the products and services offered by the Sweepstakes Entities.This promotion is in no way sponsored, endorsed, administered by, or associated with any other entity other than the Sweepstakes Entities. By entering you acknowledge and warrant that you understand that you are providing your information to the Sweepstakes Entities.
  • If you have any further inquiries about the Sweepstakes or if you do not wish to be contacted for purposes other than prize notification, please follow opt-out instructions provided in any such communication or email hello@thewildhoneypie.com.
  • For a list of Sweepstakes winners, mail a self-addressed, stamped envelope after the Entry Period to TWHP at the address below. Residents of VT may omit postage.
